Diamond Motor Cars

On Sunday, 10/18/15, I purchased a van from Mark Tomaino at Diamond Motorcars, Inc. located in Bellflower CA. Without haggling, I happily wrote check to buy the van on the spot, including all taxes and legal fees, for the advertised price and we both signed the sales contract. It was mine to drive home that day! Unfortunately, I was solo so I informed them I would be back on Thursday (10/22) to pick up the vehicle.



On Tuesday (10/20) I get a call from Mark saying they are holding my van ransom unless I pay an additional $500.00 above the advertised price or they would unilaterally cancel the sale. I was (am) livid! Deceptive and illegal per California Vehicle Code CA Vehicle Code 5901(d) and counters the terms of the signed contract.



I desperately needed the van for my livelihood so I negotiated the ransom down to $300.00 and was forced to sign a new contract in order to take possession of my van.



Would I recommend them? Absoluteness not!



A DMV investigation has been initiated and a subpoena forthcoming for small claims court unless I am compensated.
