Child Support
When parents divorce, they both have a legal duty to provide financial support for their minor children, ensuring that children's physical and emotional needs are being met. In many cases, the non-custodial parent will pay child support to the custodial parent, but due to recent changes to Illinois law, calculating the amount of these child support payments is often very complicated, requiring the assistance of an experienced attorney.
Child Custody and Visitation
When parents decide to dissolve their marriage and get a divorce, they must make some difficult decisions about how they will continue raising their children in two separate households. Unfortunately, disagreements over child custody (now known in Illinois as the allocation of parental responsibility) can become highly contentious, and working out how to resolve these issues often requires the assistance of a knowledgeable, experienced divorce attorney.
Paternity
When establishing paternity through administrative or judicial processes, the parents and child may be required to submit to DNA testing. If DNA tests show that there is at least a 99.9% probability that the alleged father is the biological father of the child, then they will be presumed to be the child's legal parent. If an alleged parent refuses to submit to genetic testing, the court may find in the other party's favor and decide that they are the legal parent of the child.
Premarital Agreement
When a couple decides to get married, they will likely be combining nearly every aspect of their lives, including the property they own, the income they earn, and other personal, financial, and legal concerns. While the possible end of their marriage is probably the last thing on their minds, couples may want to decide how these various aspects will be handled in the case of divorce or the death of a spouse. By creating a premarital agreement (also known as a prenuptial agreement or "prenup"), couples can ensure that they will be protected should the unthinkable happen.

Spousal Support
When a couple decides to end their marriage through divorce, the ensuing changes to their lives can cause a great deal of uncertainty and anxiety, especially when one spouse worries that they will have difficulty supporting themselves and their family. However, when there is a significant difference between the incomes that spouses earn, or when one spouse's earning ability is impaired because they chose family obligations over career advancement, the law allows them to seek financial support (known as spousal maintenance, spousal support, or alimony) from their former partner.
Legal Separation
Non-marital property which was acquired by one spouse prior to the marriage, after legal separation, or by gift, legacy, or descent is not subject to equitable division. However, marital and non-marital property may become commingled, such as when one spouse contributes non-marital funds toward the purchase or maintenance of a marital home or when one party contributes effort to a non-marital home. Depending on the circumstances, commingled property may be converted to marital property, or a spouse may be reimbursed for their contribution to the other spouse's non-marital property.

Trusts and Estates

Wills
When a spouse is eligible to receive maintenance following divorce, the amount of maintenance is determined by a formula defined in Illinois statutes. Maintenance is found by calculating 30% of the higher-earning spouse's gross income, then subtracting 20% of the lower-earning spouse's gross income. The resulting amount, when added to the lower-earning spouse's gross income, cannot be greater than 40% of the spouses' combined gross incomes. The duration that maintenance payments will last will depend on the length of the spouses' marriage.
